Enquiries and instructions
An enquiry does not by itself establish an attorney-client relationship or a mandate. Work is accepted after the firm’s intake and conflict checks and agreement on the terms of engagement. Please do not use the website enquiry form for urgent instructions or sensitive documents.
Confidentiality, privilege and technology
The firm treats enquiries confidentially. Legal privilege depends on the circumstances and applicable law; it is not automatically created by submitting a web enquiry. AI-assisted drafting and research, automation and office workflows support the firm’s work. Eugene remains responsible for legal advice and work delivered.

Website enquiry data
The proposal-request button opens a Microsoft Forms form operated by E Botha and Associates Inc. We collect the name, business name and email address you provide, together with any optional summary and meeting preferences, to respond to your request and discuss the proposed relationship. The information is stored in our Microsoft 365 environment; Microsoft services process it to provide the form, workflow and email delivery. An automated email supplies the requested proposal overview and Eugene is notified of your enquiry. Providing a name, business and email address is necessary for this request route; you can instead contact Eugene directly using the details above. Please do not submit sensitive documents or urgent legal instructions. We retain enquiry records for responding, managing the discussion and applicable record-keeping obligations. Contact Eugene to request access, correction or deletion of your enquiry information, or to ask us to stop contacting you, subject to applicable legal obligations. A proposal request does not subscribe you to unrelated promotional communications.

What we collect and why
We may record your name, business role, organisation, public professional profile and business contact details from company websites, published vacancies, LinkedIn or information you give us. We record the source, relevant business context, our correspondence and your contact preferences. We use this information to assess whether our services may be relevant, seek permission where required, respond to enquiries and manage agreed discussions.
A public profile or a job advertisement does not give us permission to send you a marketing sequence. Where we make a first request for consent, responding is voluntary. Declining or not replying means we will not send the proposed overview or a reminder to that request. Agreeing to a particular conversation does not subscribe you to our newsletter.
Who processes the information
Eugene and people authorised to assist with EBi’s marketing may use these records. We keep working records on our office systems and in Microsoft 365, including Outlook, OneDrive and SharePoint. LinkedIn and Sales Navigator process profile information, saved leads and messages when we use those services. OpenAI tools, including ChatGPT and Codex, assist with research, organising information and drafting; relevant business information and selected correspondence may be processed through those tools. Please keep confidential legal instructions and sensitive documents out of initial marketing conversations and arrange an appropriate channel with Eugene.
Processing outside South Africa
These are international services, so information may be processed outside South Africa, including in the United States. The applicable laws and available remedies may differ from those in South Africa. Microsoft’s commercial data-protection terms include confidentiality, security and transfer provisions. LinkedIn’s own privacy policy describes its international processing and transfer mechanisms; it also processes information for its own platform purposes. OpenAI’s handling depends on the service and applicable account terms. This notice does not promise that information remains in South Africa or that every provider has identical protections. You may contact Eugene for details relevant to your information.

Your choices and records
We retain relevant records while assessing or discussing the relationship and for applicable record-keeping obligations. We keep a limited record of consent, refusal or withdrawal to respect your choice and avoid repeated approaches. You may ask us to access, correct or delete your information, object to its use for marketing, or withdraw permission by replying to our message or emailing eugene@ebilaw.co.za. Deletion is subject to lawful record-keeping requirements. You may also complain to the Information Regulator, at enquiries@inforegulator.org.za or 010 023 5200.
Cookies and website preferences
The website does not set advertising cookies. If you choose to remember your display preference, we store your light or dark choice in your browser’s local storage. We also store your response to the preference notice so it does not keep appearing. You can change that choice using “Cookie preferences” at the bottom of any page or clear it through your browser settings. Search runs in your browser without sending your search terms to an external search service. Outbound website links may include campaign labels; we do not add your email address, search terms or other personal details to those labels. External websites, including Microsoft Forms, have their own privacy and cookie arrangements.
Website traffic and performance
We use Cloudflare Web Analytics to understand which pages people visit, referring websites and how well our website loads. Your browser sends page and performance information to Cloudflare, which also hosts this website. This analytics service does not use cookies or local storage to track visitors. We do not send proposal-form answers or legal instructions to it, and we do not use it for advertising profiles. Campaign labels in links are not recorded by this service. Business law updates
Requesting updates is optional and separate from requesting a proposal. The “Request email updates” link opens your email app with a request you can review and send to Eugene. Opening the link does not subscribe you. We use the email address and consent in your email to review your request and manage business law updates. These messages are stored in our Microsoft 365 environment. To withdraw your request, unsubscribe, request access or correction, or ask for deletion, email eugene@ebilaw.co.za. We retain the record while managing your request or subscription and as needed to record your consent or withdrawal. We do not sell your email address.
Retainer pricing and scope
The monthly fee is R15,000 plus VAT: R17,250 including VAT at 15%, plus agreed disbursements. It covers the ongoing day-to-day business legal relationship, without hour or document quotas. If a matter needs external advisers or substantially more work than the ongoing day-to-day relationship covers, Eugene will explain it and agree any separate scope and fee with you before proceeding. A busy month alone does not use up your access. Company secretarial work and routine company administration, including statutory filings and register maintenance, are excluded. We can arrange these through an associate, with the scope and fee agreed separately. Legal advice on governance and business decisions remains part of the relationship. The mandate records the client entity, engagement terms and approval process. No legal outcome is promised.
