Eugene Botha

Commercial judgement, shaped by more than two decades working with founders.

Admitted as an attorney in March 2004, Eugene has practised independently since 2014. His experience spans commercial litigation, employment, B-BBEE, mergers and acquisitions, corporate finance and governance.

He approaches agreements with both the transaction and the potential dispute in mind. His role is to understand what the client wants to achieve, find a workable legal structure and take responsibility for the advice the firm delivers.

Eugene is based in Cape Town and commutes to Johannesburg. Clients work with him in person and online.

Mrs. Rahman manages EBi’s finance function and supports the financial administration of the practice. Her role sits alongside Eugene’s responsibility for the legal work.

Wilma handles company secretarial work, including the company administration and statutory records that sit alongside a business’s legal arrangements. This work is scoped and charged separately from the legal retainer.

Commercial Specialist

Supports contract research, drafting and review, including supply agreements, service arrangements and confidentiality terms. Helps identify obligations, remedies and points for Eugene to consider before a document is settled.

Litigation Specialist

Supports the preparation of commercial disputes through research, document analysis and draft pleadings. Brings the facts, relevant authorities and procedural questions together for Eugene’s assessment and direction.

Employment & Labour Specialist

Supports research and preparation for employment agreements, workplace processes and labour disputes. Helps organise the facts and issues so Eugene can give practical advice on the next step.

Corporate & Transactions Specialist

Supports acquisitions, share and asset transactions, joint ventures and shareholder arrangements. Assists with due diligence and drafting, including the B-BBEE and governance questions that a transaction may raise.

Credit & Recoveries Specialist

Supports the analysis and preparation of credit and debt-recovery matters. Helps assemble the contractual history, payment records and enforcement questions for Eugene’s review.

Property & Leasing Specialist

Supports research and drafting for property transactions, commercial leases and property disputes. Any conveyancing or registration work requiring a separately appointed practitioner is agreed with the client.

Public & Administrative Law Specialist

Supports research and preparation where a business deals with public authorities, procurement or administrative decisions. Helps organise the record and identify questions about the decision, process and available remedies.

Why I do this work

I grew up watching my father run his own business.

There were good times and very difficult times. What stayed with me was how hard he sometimes had to fight to get paid for work he had already done. He also ran into problems that proper legal advice could have helped him anticipate, but speaking to a commercial attorney felt beyond his means.

It was only years into practice that I understood how much this had influenced me. I wanted to help my father. Today, I want to be the attorney I wish he had been able to phone.

I enjoy working with ambitious people who are prepared to try things and build something of their own. I want the legal arrangements around them to support that ambition, and to help protect the business and the people who depend on it when things do not go to plan.
